|
| |
During a divorce proceeding there are many questions surrounding spousal support. The attorneys and lawyers who specialize in this area of law at the Los Angeles California law firm of Donel and Associates have the experience you need to ensure an amicible solution for all parties.
Alimony - The courts within the State of California, can award support to either spouse, without regard to marital misconduct. The goal however in awarding spousal support is to help the spouse receiving alimony to become self-sustaining in a reasonable amount of time. Historically, the California courts consider one-half the length of the marriage to be a reasonable time for a spouse to become self-supporting.

Some of the factors the court will consider in determining the length and amount of an award of spousal support include, but are not limited to:
1. The supported spouse's marketable skills; 2. How, and to what extent, has the supported spouse's present or future earning capacity has been impaired due to roles and duties of the marriage; 3. The full extent that the supported spouse contributed to the earning capability of the supporting spouse; 4. The overall ability of the supporting spouse to be able to pay; 5. The needs of each party; 6. The obligations and assets of each of the parties; 7. The length of the marriage; 8. The age and overall health of both of the parties; 9. Any other factors the court deems are equitable and just. ACC 4320
